It has become a regular practice for any big or small business to reach out to their prospect or existing customers by using calling or SMS technology. The primary purpose of such commercial communication is to advertise or promote a new product or to share any kind of information / services on an existing product. These types of commercial/service related communication activities fall under the Telemarketing category, governed under the TCCCPR Guidelines from TRAI.
According to the TCCCPR 2018 guidelines released by TRAI, a person or legal entity engaged in the activity of transmission or delivery of commercial/service related communication or scrubbing or aggregation is classified as a Telemarketer. For providing telemarketing services, Telemarketers and their respective Principle Entities need to register on the DLT platform of any of the registered Indian Telecom Service Providers (TSP). This is an evolving regulation and with the increase in unsolicited commercial communication across the country and rise in the number of customer complaints, TRAI has made the regulation stricter for Telemarketers.
